Either public drunkenness or drinking under age, or both, depending on where she was and how old she was at the time. Your sister did nothing wrong because she was unaware of her condition. This circumstance is analogous to someone starting their car while a kitten is lying on the warm engine. The kitten may die, but not because the driver of the car intended its death.

If your sister had known she was pregnant and her drinking led to the death of her unborn child, then she should be charged and face a jury of her peers in a court of law. Just like if her drinking led to the death of her toddler because she failed to supervise her child. There really is no difference between these two scenarios. A human being is just as valuable inside the womb as outside the womb.
