She should be charged with public drunkenness or drinking under age, or both, depending on where she was and how old she was at the time. Your sister did nothing wrong because she was unaware of her condition. This circumstance is analogous to someone starting their car while a kitten is lying on the warm engine. The kitten may die, but not because the driver of the car intended its death.
If your sister had known she was pregnant and her drinking led to the death of her child, then she should be charged with chemical endangerment of a child and face a jury of her peers in a court of law. Just as if her drinking led to the death of her toddler because she was driving drunk. A child is just as valuable inside the womb as they are outside the womb.
